General Terms and Rental Conditions for Holiday Accommodation
1. Scope
These General Terms and Rental Conditions apply to all bookings of holiday accommodation made directly through this website. Upon the binding completion of the booking, these General Terms and Rental Conditions become part of the rental agreement between the landlord named in the legal notice and the guest. Supplementary rules and house regulations may apply to individual properties. These will be displayed on the relevant property page or during the booking process and will also form part of the rental agreement.
2. Landlord and Contracting Party
The guest’s landlord and contracting party is the person named in the legal notice on this website. Information relating to the relevant property, the rental price, the services included and any additional costs is set out in the property description, the booking summary and the booking confirmation.
3. Booking Process and Formation of the Contract
The presentation of the holiday accommodation on the website provides information about the available properties and booking options. Before submitting a binding booking, the guest will receive a summary of the selected property, the period of stay, the number of guests, the services included, all mandatory costs and the full total price. The guest may review and, where necessary, correct the information provided before submitting the booking. Before completing the binding booking, the guest must confirm that they have read and accepted these General Terms and Rental Conditions, the payment and cancellation conditions and the privacy policy. By clicking the appropriately labelled booking button, the guest submits a binding booking that entails an obligation to pay. The rental agreement is concluded once the booking has been confirmed electronically or in writing by the landlord. Following completion of the booking, the guest will receive a booking confirmation by email.
4. Occupancy and Use of the Property
The property may be used exclusively by the persons specified during the booking or online check-in process. The maximum number of persons stated in the property description and booking confirmation may not be exceeded. Additional unregistered overnight guests are not permitted. Subletting, re-letting or otherwise making the property available to unregistered persons is prohibited. The property may be used exclusively for private holiday and recreational purposes. Parties, events, commercial activities and disruptive gatherings are not permitted.
5. Prices and Display of the Total Price
The nightly price applies to the entire booked holiday property and to the number of persons stated in the booking. Before the binding completion of the booking, the guest will be shown the full total price, including all mandatory costs. Costs that are compulsory for the booked stay will not be added to the displayed total price after the booking has been completed. Unless expressly stated otherwise on the relevant property page or in the booking summary, the nightly price includes, in particular, any applicable tourist tax or visitor’s tax, bed linen, hand and bath towels, Wi-Fi, electricity and water, use of the available air-conditioning systems and the usual ancillary costs. In addition, a one-off final cleaning fee in the amount shown during the booking process will be charged per stay. This fee amounts to EUR 80 unless a different amount is stated on the relevant property or booking page. The final cleaning fee will be included in the full total price displayed before the binding completion of the booking.
6. Payment Conditions
The total amount payable, the payment method and the payment deadline will be stated during the booking process and in the booking confirmation. Payment must be made using the payment method offered on the website or to the account specified in the booking confirmation or invoice. Payment is deemed to have been made once the full amount has been received by the landlord or the appointed payment service provider. If payment is not made within the stated period, the landlord may request payment from the guest and grant a reasonable additional period for payment. If payment is still not made by the end of this additional period, the landlord may withdraw from the booking and release the property for rental again.
7. Cancellation by the Guest
A cancellation is free of charge if the written cancellation notice is received by the landlord no later than seven calendar days before the agreed arrival date. The time at which the cancellation email is received is decisive. The local time at the location of the booked property applies. In the event of a timely cancellation, any payments already made will be refunded in full. If the cancellation is received fewer than seven calendar days before the agreed arrival date, 50 percent of the total booking price will be charged or retained. If the total amount has already been paid, 50 percent of the total booking price will be refunded. The remaining 50 percent will be retained as a cancellation fee. In the event of a no-show without prior cancellation, 50 percent of the total booking price will likewise be charged or retained. Early departure during the booked stay does not generally entitle the guest to a full or partial refund. The guest remains entitled to demonstrate that the landlord suffered no loss or a substantially lower loss.
8. No General 14-Day Right of Withdrawal
For the booking of accommodation services for a specifically agreed date or period, there is generally no general 14-day right of withdrawal. Following the binding conclusion of the contract, the cancellation conditions set out in these General Terms and Rental Conditions therefore apply. The option of cancelling free of charge up to seven calendar days before the agreed arrival date remains unaffected.
9. Arrival and Departure
The check-in and check-out times stated in the booking confirmation must be observed. Earlier arrival or later departure is only possible following prior agreement and express confirmation by the landlord. Access codes, keys and other means of access may not be passed on to unauthorised or unregistered persons. When leaving the property, all windows and doors must be closed. Air-conditioning systems, lighting and electrical devices that are not required must be switched off. On the departure date, keys and other means of access must be returned or deposited in accordance with the instructions provided.
10. Guest Information and Identity Documents
All guests must provide the personal information required for the processing of the booking and for any legally required registration fully and accurately. Where required by law at the location of the property, the details of a valid identity document must also be provided before arrival. The information submitted must correspond to the persons who actually arrive. Access to the property cannot be guaranteed without the timely and complete submission of the legally required guest information and identity details.
11. Peace, Quiet and Consideration
The properties may be located in residential buildings or buildings containing several separately used residential units. Other guests or residents may therefore be present in the same building or the immediate surrounding area during the stay. Consideration must be shown to other guests, residents and the neighbourhood at all times. Excessive noise must be avoided, particularly during the evening and night. The quiet hours and local regulations applicable at the location of the property must be observed.
12. Smoking Ban
The properties offered are entirely smoke-free. Smoking is strictly prohibited inside the holiday accommodation, in shared indoor areas, stairwells, front and inner courtyards, and on balconies and terraces. The smoking ban also applies to electronic cigarettes, vaporisers and comparable products. If a violation results in additional cleaning, odour treatment or restoration measures, the guest responsible may be charged the costs actually incurred.
13. Pets
Pets and other animals are not permitted inside the properties or on the associated premises. This expressly includes small dogs, cats and other small animals. Mandatory statutory exceptions, particularly for recognised assistance animals, remain unaffected.
14. Duty of Care and Damage
The property, furniture, technical equipment and all furnishings must be treated with care. Damage, defects, exceptional soiling or missing items must be reported to the landlord immediately. In accordance with the applicable legal provisions, the guest is liable for damage culpably caused by the guest, accompanying persons or visitors. Lost or damaged keys, means of access and necessary replacements may be charged to the guest in the amount of the costs actually incurred. No liability exists for damage resulting from normal use and wear and tear of the property or its furnishings.
15. Defects and Complaints
Any defects or disruptions identified must be reported immediately to the landlord or the designated contact person. The landlord must be given a reasonable period within which to inspect the reported defect and, where possible, remedy it. The guest is required to take reasonable steps to help limit any potential damage.
16. Air Conditioning and Energy Consumption
Air-conditioning systems, heating systems and electrical appliances must be used responsibly and solely for their intended purpose. Air-conditioning and heating systems may not be operated while windows or doors are left permanently open. When leaving the property, air-conditioning systems, heating systems and electrical appliances that are not required must be switched off.
17. Unavailability of the Property
If the booked property cannot be provided due to an unforeseeable event, significant damage, an official order or another circumstance beyond the landlord’s control, the guest will be informed as early as possible. Where possible, the guest may be offered comparable alternative accommodation. The guest is not obliged to accept such an alternative offer. If no suitable alternative accommodation can be offered or the guest justifiably rejects it, any payments already made for services not provided will be refunded. Any further mandatory statutory rights remain unaffected.
18. Data Protection
Personal data will be processed exclusively for the purposes of booking administration, guest communication, payment processing, organisation of the stay and compliance with legal obligations. Where necessary for the performance of the booking, data may be transferred to payment service providers, booking systems, local contact persons or the competent authorities. 19. Applicable Law and Place of Jurisdiction
To the extent permitted by law, the contractual relationship between the landlord and the guest is governed by Swiss law. To the extent permitted by law, the courts of the Canton of Zurich, Switzerland, are agreed as the place of jurisdiction for disputes arising from or in connection with the rental agreement. Mandatory statutory places of jurisdiction and mandatory consumer protection provisions remain unaffected. In particular, a choice of law may not result in the guest being deprived of mandatory rights that would apply under the law applicable in the absence of such a choice. Mandatory statutory and public-law provisions at the location of the relevant property, including registration, safety, tourism and tax regulations, also remain unaffected.
20. Final Provisions
If individual provisions of these General Terms and Rental Conditions are wholly or partially invalid or unenforceable, the remaining provisions will remain unaffected. The applicable statutory provisions will replace any invalid provision. Mandatory statutory rights of guests remain unaffected by these General Terms and Rental Conditions. By completing the binding booking, the guest confirms that the full total price, including all mandatory costs, was displayed before the booking and that the guest has read and accepted these General Terms and Rental Conditions, in particular the payment, cancellation and jurisdiction provisions.
